
A factory supervisor in Johor has been convicted and fined after he was caught secretly filming another man inside a toilet cubicle, an act that cost him RM3,000 and very nearly landed him behind bars.
Na Yeow Sing, 31, appeared before the Magistrate’s Court in Batu Pahat where he entered a guilty plea to a charge brought under Section 509 of the Penal Code.
The section covers acts that intentionally insult the modesty of another person.
Victim chased him down
The incident unfolded when the complainant was using the toilet and noticed Na filming him from above the cubicle wall.
The complainant gave chase, caught Na, and then approached a security guard to contact the police.
Officers arrived at the scene at around 6pm that day.
Na was handed over to them, and a subsequent check of his mobile phone confirmed the existence of the video recording.
The device was seized and held as evidence for the investigation.
Escaped jail by a fine margin
In court, Na did not contest the charge and pleaded guilty to the offence.
Magistrate Nurasidah A. Rahman sentenced him to a fine of RM3,000, with three months’ imprisonment set as the consequence if he was unable or unwilling to pay.
Under Section 509 of the Penal Code, an individual found guilty of insulting the modesty of a person can face up to five years in prison, a fine, or both.
Na’s sentence sat at the lower end of what the law permits, and he ensured jail was taken off the table entirely by paying the fine on the spot.
This is not an isolated incident.
Secret filming cases have surfaced with some regularity in Malaysia, with perpetrators targeting victims in changing rooms, toilets and other private spaces.
In many of these cases, it is the vigilance of the victims themselves , or those nearby that leads to the perpetrators being caught and brought to court.
In this instance, the complainant’s swift response in confronting Na directly and involving the authorities was what ultimately led to the conviction.
